What are the indicators that capacity is an issue?

The signs will be there. Grubby nails, maybe, or inappropriate clothing. An inability to recognise that their home should be cleaned on a regular basis. Decisions which have tangible benefits which those who do have mental capacity can correctly gauge. The worry is in the implications. What if they’re oblivious to the dangers of a hot kettle when making a cup of tea? Or traffic when they’re heading out to the shop? If they’re unable to weigh up the pros and cons of situations like these and make informed choices, then they may lack mental capacity and measures will have to be put in place to safeguard their welfare. If this is the case, then our team at Donnelly & Kinder in Belfast can help you through the process.

The Mental Capacity Act is there to keep you safe

The Mental Capacity Act (NI) 2016 is hugely significant and brings together mental health and mental capacity legislation into one Act. The first phase of the Act came into operation at the end of 2019 and relates to areas such as the deprivation of liberty. Further provisions relating to people who lack capacity to make decisions for themselves are still to come into force, along with various codes of practice. The team at Donnelly & Kinder will ensure that they keep abreast of all developments in this area of the law to ensure that they can provide the most up to date and detailed advice to clients.
