Why do you need an EPA?
Enduring Powers of Attorney (EPAs) are designed to protect your interests. They are legal documents that identify someone of your choosing to manage your affairs should you suffer a debilitating accident or illness. In terms of practical examples, it’ll give someone the power to manage your financial affairs, to include dealing with your bank accounts on your behalf. But the caveat is that an EPA can only be put in place by you and that you must have the mental capacity to action it and decide the particulars. If you don’t do this and you do become ill or have an accident which leaves you unable to manage your affairs, then your family does not have the automatic right to do this for you. They will have to apply to court and the court will decide who has the final say over your affairs. Such a process is expensive, time-consuming and needlessly traumatic.
