Disability Discrimination in Education

  • It is very important that reasonable adjustments are made in schools to cater for the pupils with special educational needs.

  • If the decision of the Education Authority is discriminatory towards the child, a potential challenge can be brought to a SENDIST Tribunal and by way of Judicial Review

  • If you believe your child has been discriminated against and require further advices, contact our team at info@donnellykinder.com

How we can help

If you believe your child has been subject to discrimination within the classroom or in the school setting, an action can be brought to the Special Educational Needs and Disability Tribunal (SENDIST).

An action can be brought within six months of the discriminatory act. Through the guidance of solicitors at Donnelly & Kinder, we can review the circumstances of the incident, apply to the criteria sent out by the Tribunal, and advise on the merits of a claim. We will help prepare the application and can provide legal representation at the SENDIST Tribunal.
